Service Guarantee and Limitation of Liability
This text sets out the scope of the service guarantee and the limits of liability for Prime VIP Transfer services (VIP transfer and tours), in accordance with the Turkish Law of Obligations, Consumer Protection Law No. 6502 and the Turkish Commercial Code.
1. Service Guarantee
Prime VIP Transfer undertakes to provide the service in accordance with the standards specified in the reservation confirmation (vehicle type, time, route). If the service is not performed in line with these standards, remedies such as compensation, refund or alternative service are applied within the legal and contractual framework. Consumer rights are reserved.
2. Limitation of Liability
To the extent permitted by applicable law: (a) Liability is limited to direct and foreseeable loss; claims for indirect loss, loss of profit or non-pecuniary damage are accepted only where provided by law. (b) Total compensation does not exceed the price of the relevant service (unless the law provides for higher compensation). (c) In cases of force majeure, liability is limited in accordance with the law.
3. Liability in the Platform (Intermediary) Model
Where the service is provided by a third-party provider, primary liability arising from the transport service lies with that provider. The platform's liability is limited to the proper and lawful provision of intermediation; any intermediary liability prescribed by law remains applicable.
4. Time Limits and Notice
A party claiming loss must notify Prime VIP Transfer in writing within a reasonable time after becoming aware of the loss. Statutory limitation periods apply.
